Citizenship Through Marriage

This refers to the application for registration as a citizen of Kenya by a spouse of a Kenyan citizen. Section 11 of the Kenya Citizenship and Immigration Act, 2011 provides for a person who has been married to a citizen of Kenya for a period of at least seven (7) years shall be entitled, on application, in the prescribed manner to be registered as a citizen of Kenya, if:-

 

  1. The marriage was solemnized under a system of law recognized in Kenya, whether solemnized in Kenya or outside Kenya;
  2. The applicant has not been declared a prohibited immigrant under this Act or any other law;
  3. The applicant has not been convicted of an offence and sentenced to imprisonment for a term of three years or longer;
  4. The marriage was not entered into for the purpose of acquiring a status or privilege in relation to immigration or citizenship; and
  5. The marriage was subsisting at the time of the application.

 

The requirements include: -

  1. Applicant to complete form 8;
  2. Copy of Applicant’s birth certificate;
  3. Copy of applicant’s foreign passport;
  4. Copy of Applicant’s pass or current & previous work permit(s);
  5. Copy of PIN Number;
  6. Copy of Marriage certificate;
  7. Copy of Kenyan birth certificate of Spouse;
  8. Copy of Kenyan passport of spouse;
  9. Copy of Kenya National Identity Card of Spouse;
  10. Two (2) passport size photographs;
  11. Certificate of good conduct;
  12. Questionnaire for intending applicants (Print the questionnaire for application);
  13. A joint sworn affidavit;
  14. Copy of dependant’s pass or permit;
  15. Fee is as follows: -
